The team of Professional Disciplinary barristers at Queen Square Chambers fully appreciates the anxiety and reputational damage that can be caused by allegations of misconduct and the internal and/or external disciplinary proceedings that may follow. When acting for individuals, our barristers fully understand the importance of offering prompt and realistic advice together with supportive and reliable representation in order to mitigate the negative impact of disciplinary action as effectively and as quickly as possible.
Members have appeared before various regulatory and disciplinary tribunals including the General Medical Council (GMC), the Nursing and Midwifery Council (NMC), the Health Professions Council (HPC) and the Care Quality Commission (CQC) amongst many others, usually for practitioners.
Our barristers represent individuals from a variety of professional fields including accountants, sportsmen and women, brokers, doctors, nurses, dentists, vets, physiotherapists and chiropractors in proceedings before the different regulatory bodies involved. However, members also accept instructions from regulatory bodies to prosecute disciplinary proceedings.
The team further has experience of Judicial Review proceedings arising as a result of professional disciplinary decisions by regulatory bodies.
In addition, members of the Professional Disciplinary team provide representation at internal disciplinary hearings conducted by the employer, both on behalf of individuals under investigation, and employers (such as NHS Trusts).
Our experienced team offers expertise in the following areas:
- Internal disciplinary/dismissal hearings, for employers and employees
- Prosecution and defence of professional disciplinary proceedings brought by external regulatory bodies
- Fitness to practice
- Registration issues
- Courts Martial
- Judicial Review of decisions of ‘reviewable’ regulatory bodies
