Practice Profile:

Julian has a specialist employment practice which covers all aspects of the Employment Tribunal jurisdiction and related claims in the High Court and County Court.  He has regularly appeared in Employment Tribunal hearings which have included issues of unfair dismissal, wrongful dismissal and breach of contract, whistleblowing and victimisation, sex, race, disability and age discrimination, Equal Pay, restrictive covenants, part time workers, unauthorised deductions from wages, agricultural wages and TUPE 2006. Julian also has a particular interest in matters affecting remedy and quantum, including claims involving complex aspects of causation and / or an element of personal injury arising from discrimination.

Julian is an experienced, pragmatic and versatile employment law practitioner.  His practice includes both Claimant and Respondent work.   In addition to private sector businesses, his Respondent clients include Housing Associations, Local Authorities, medical practices, NHS Trusts and schools.  He has developed an understanding of the particular issues faced by these public bodies in the Employment field, and how to conduct litigation on their behalf.

Since being appointed as Junior Counsel to the Crown in 2007, Julian has also advised, drafted for and represented Government Departments in employment matters.

Julian also accepts instructions in Special Educational Needs and Disability Needs Tribunal (SENDIST) cases. He also advises in relation to internal disciplinary hearings.

Julian has a particular expertise in Employment cases that bridge the interface between Employment law and Commercial litigation as a result of his considerable experience and skill in commercial and construction matters where he is separately listed in the Legal 500 as having particular proficiency (see below).

Julian is a trained mediator and is listed in the Bar Council's list of Barrister Mediators.

    Successful appeal against procedurally irregular ET judgment.
  • Savage v HMRC [2011] – ET-
    Successful defence of a complex victimisation and disability discrimination claim brought by a former employee.
  • Knowles v Department for Work and Pensions (2010) – ET-
    Successful defence of a complicated reasonable adjustments claim against a serving employee.
  • Cave v Portsmouth CC [2008] All ER (D) 313 (May)
    Employment Appeal Tribunal hearing on agency workers- ultimately successful for PCC upon remission to the Employment Tribunal.
