Called 2006 (Inner Temple)
Simon has an eye for detail but is able to get to the crux of a complex matter within a short-time frame. He is a calm, clear and precise advocate whose questions are carefully constructed to get the best possible evidence from each witness. Simon adopts a friendly yet professional approach towards his clients and having had experience in advising and representing a diverse array of clients, from those suffering from conditions such as bi-polar through to experienced Trade Union representatives and partners of law firms, he is particularly adept in providing advice in a manner appropriate for each specific client.
Simon regularly provides seminars on all areas of employment law to law firms specialising in this area, with his seminars in recent years covering the ramifications of the Equality Act 2010 and how to construct schedules of loss where more complex issues are involved such as career long losses, ‘grossing up’ for tax purposes and interest calculations.
Simon’s interest in Employment Law started during his BVC when he was actively involved with several FRU Employment Tribunal hearings and upon completion of his pupillage at Queen Square Chambers he rapidly started to specialise and develop his practice in this area of law.
Simon has extensive experience in the following areas:
- All aspects of unfair dismissal including constructive unfair dismissal
- Redundancy
- Wrongful dismissal
- All other contractual claims (unlawful deduction of wages etc.)
- All areas of discrimination
- Protected disclosures (whistleblowing)
Simon also has had some experience in the following practice areas:
- Pension Losses
- Equal Pay
- TUPE
- Restrictive Covenants (including injunctive relief)
Simon’s other specialism is that of Personal Injury which he finds a useful counterpart to his employment practice especially in terms of calculating future losses and advising clients when there is (as there appears to be with increasing frequency) a cross-over between a client’s employment rights and a potential claim for personal injury.
Recent Notable Cases
- 2 week multi-claimant whistleblowing and unfair dismissal claim
- 4 day age discrimination claim involving physical assaults by co-workers both in and outside the work premises
- 4 day hearing involving claims of disability discrimination (arthritis), constructive unfair dismissal and victimisation. This case was interesting as we successfully applied for a witness order on the first day of the hearing and one of the Respondent’s main witnesses was critically ill and on a permanent oxygen supply which clearly necessitated careful cross examination
- 3 day constructive unfair dismissal hearing where there was a separate but overlapping PI settlement which raised interesting double recovery questions
- 3 day disability discrimination (endometriosis) claim
- 3 day whistleblowing and redundancy hearing Sex discrimination claim involving a nude male model
- 3 day multiple-respondent sexual harassment claim
